Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Custive platform and services provided by PT Arah Baru Global ("Custive", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Definitions

The following terms have specific meanings throughout this agreement:

  • "Platform" refers to the Custive AI-powered omnichannel customer platform, including all features, APIs, and related services.
  • "User" or "You" refers to the individual or entity that registers for and uses the Platform.
  • "Customer" refers to your end customers whose conversations are managed through the Platform.
  • "AI Agent" refers to the automated AI-powered response and action system provided by the Platform.
  • "Subscription" refers to the paid plan selected by the User to access Platform features.

2. Account Registration

To use Custive, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You may use the Platform solely for lawful business purposes in accordance with these Terms. You are responsible for all content transmitted through the Platform, including messages sent by your AI Agent. You must ensure your AI Agent's responses comply with applicable laws and regulations, and you must configure appropriate escalation rules for sensitive matters.

4. Prohibited Use

You agree not to use the Platform for any of the following:

  • Sending unsolicited messages (spam) or violating anti-spam laws.
  • Transmitting harmful, offensive, defamatory, or illegal content.
  • Impersonating any person or entity, or misrepresenting your affiliation.
  • Interfering with or disrupting the Platform's infrastructure or other users' access.
  • Attempting to reverse-engineer, decompile, or extract source code from the Platform.
  • Using the Platform to collect personal data without proper consent from data subjects.
  • Reselling, sublicensing, or redistributing access to the Platform without written authorization.
  • Using the Platform in any way that violates applicable Indonesian or international laws and regulations.

5. Intellectual Property

The Platform, including its design, code, AI models, features, and documentation, is owned by PT Arah Baru Global and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Platform. You retain ownership of your data and content. By using the Platform, you grant us a limited license to process your data as necessary to provide the services.

6. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. You acknowledge that customer conversation data processed through the Platform may be stored and processed in accordance with our data handling practices. You are responsible for obtaining necessary consents from your customers for data processing through the Platform. We implement multi-tenant data isolation to ensure your data remains separate from other users.

7. Payment and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are quoted in Indonesian Rupiah (IDR) unless otherwise stated. Prices are exclusive of applicable taxes. We reserve the right to modify pricing with 30 days' prior notice. Failure to pay may result in service suspension or termination. Refunds are handled on a case-by-case basis.

  • Free trial periods, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends.
  • Usage exceeding your plan limits may result in additional charges or temporary service throttling.
  • Annual subscriptions may be eligible for discounts as advertised at the time of purchase.

8. Service Availability

We strive to maintain 99.9% platform uptime. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors beyond our reasonable control, including internet outages, third-party service disruptions (e.g., WhatsApp API, payment providers), force majeure events, or actions by your systems or end users.

9. Limitation of Liability

To the maximum extent permitted by law, PT Arah Baru Global shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill. Our total liability for any claim arising from or related to these Terms shall not exceed the total fees paid by you in the twelve (12) months preceding the claim. AI-generated responses are provided on an "as-is" basis, and we do not guarantee their accuracy or appropriateness for every situation.

10. Indemnification

You agree to indemnify, defend, and hold harmless PT Arah Baru Global, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Termination

Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Platform ceases, and we will retain your data for 90 days before deletion unless otherwise required by law. You may request data export before termination takes effect.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the jurisdiction of the courts of Jakarta, Indonesia.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Platform at least 30 days before they take effect. Your continued use of the Platform after changes constitutes acceptance. If you disagree with the updated Terms, you may terminate your subscription.
